r_drawothermodels questions

Hello. I'd like to elaborate off of a thread made last night.
I am in a community where one member has been banned for r_drawothermodels violation; he claims it is some skins he downloaded and is trying to pull the "I've been here a long time..." card. Sadly, he was unbanned. Is it possible to have skins that can get you banned for this but without actually altering your drawothermodels?
One last thing: is it possible to enable drawothermodels client-side in a server if SV_cheats are set to 1? I thought that the server won't allow that anyway without rcon access.

To further emphasize the point, can you please explain any possible way, if any, to get banned for drawothermodels without actually having the command on?
